When do you need to complete an Affadavit of Denial?

If the mother is married to someone other than the biological father when the child is born, or was married when the child was conceived, the mother and the husband or ex-husband must complete an Affadavit of Denial in order for the biological father's name to be placed on the birth certificate.

What will happen if the mother is married and an Affadavit of Denial isn't signed?

If the mother is married and the Denial Form is not completed, the husband's (or ex-husband's) name will appear on the birth certificate and he will be considered the legal father. In this situation, in order for the biological father's name to appear on the child's birth certificate both the Certificate of Parentage and the Affadavit of Denial must be completed.

Can the Affadavit of Denial be mailed?

Yes. If you choose to mail it in, you must do the following:

Affidavit of Denial must be printed as a two-sided document.

You must read all the information on the back-side of the Affidavit of Denial before signing it.

Once you have read it and decided you want to continue, the mother and husband (or ex-husband) must fill in all fields on the form; either type or print in black or blue ink.

Remember this is a legal document so it must be legible.

Both mother and husband (or ex-husband) must sign the form and both signatures must be notarized.

Once signed, mail the form along with the completed Certificate of Parentage to:
